    Lawsuits/Administrative Appeals

    Our crucial role in this process begins with providing feedback on the proposed plans. Following this, the BLM or the Forest Service will issue a Decision of Record (DR). If legal violations persist, our next step is to file a case in the federal courts or through the Interior Board for Land Appeals (IBLA). 

     

    Please take note of the following information:

     

    The difference between federal court and IBLA is that federal court lawsuits require legal representation and can be very expensive, costing up to $200,000 per case. In IBLA cases, you can represent yourself, but it is essential to be well-versed in the regulations concerning the timing and specifications for each document submitted, as well as what needs to be proven at each stage. These regulations can be found below.

     

    Another significant difference is the speed at which a ruling will be made. Cases heard in the federal district courts are typically decided within 1 - 2 years, but the timeframe may vary based on the court's schedule and the complexities of the case. On the other hand, IBLA cases can be prolonged – we currently have cases filed by our board president in 2018 that have not yet been ruled on.
